Navigating Complex Relationships While Protecting Property Owner Interests
In the wireless infrastructure industry, tower companies and carriers are often on the opposite side of the negotiating table from property owners. At Axiom Global Wireless, our role is to exclusively represent landlords and advocate for their best interests during lease negotiations, amendments, acquisitions, and development opportunities.
Because of this dynamic, we were initially surprised when a national tower company approached our team for assistance with a tower relocation project.
Naturally, the first question was:
"Why would you want to work with us on this relocation?"
Their response was straightforward:
"You know what you are doing and have consistently demonstrated the ability to successfully complete new build ground leases and lease amendments."
While the compliment was appreciated, it immediately presented a larger challenge:
How could we assist with the relocation process while maintaining our fiduciary responsibility to property owners?
The Challenge
The tower company needed assistance identifying and securing a replacement site within a defined search area for the relocation of an existing telecommunications facility.
At the same time, our firm remains firmly committed to representing only property owners—not tower companies or carriers. Maintaining that ethical separation was critical.
Our Approach
The solution required both creativity and discipline.
Leveraging our national network of commercial real estate brokerage relationships, we partnered with a local brokerage firm that had deep market knowledge within the target search area. We structured a cooperation agreement that allowed the local brokerage team to work directly with prospective property owners while our team provided strategic guidance throughout the process.
The local brokerage firm:
• Conducted outreach to property owners within the designated search ring
• Identified qualified candidate sites
• Secured a listing agreement with a property owner interested in hosting the tower relocation
Once the site was identified, our team assisted in structuring and negotiating the proposed ground lease.
The Negotiation Strategy
Because we had previously negotiated numerous leases with the same tower company while representing landlords, we already understood:
• Their lease structure
• Their operational requirements
• Their negotiation tendencies
• The provisions that typically create long-term issues for property owners
Using that experience, we presented a ground lease template that had already been thoroughly vetted through prior negotiations on behalf of other landlord clients. The result was a lease structure that was balanced, commercially reasonable, and significantly reduced legal review costs for the property owner.
We also negotiated customized financial terms based on:
• The projected value of future subtenant carriers
• Local market lease rates
• Tower revenue potential
• Long-term site value within the surrounding real estate market
The Result
The relocation project was successfully completed with:
• A qualified replacement site secured within the required search area
• A balanced and landlord-conscious lease agreement
• Reduced legal and transaction friction
• Economics tailored to both the telecommunications value of the site and local real estate fundamentals
Key Takeaway
Cell tower relocations are highly specialized transactions that require more than simply identifying available land. Successful outcomes depend on understanding:
• Wireless infrastructure requirements
• Lease economics
• Future carrier revenue potential
• Real estate market conditions
• Long-term landlord protections
This project demonstrated that even in complex situations involving tower companies, ethical representation and strategic collaboration can create successful outcomes for all parties involved—without compromising fiduciary responsibility to property owners.
